Some Surprising Ways Prenuptial Agreements are actually in Your Favor

Pre-nups have had a bad rep in the world of marriage, most likely in part due to their success in the divorce arena. People are wont to think that it is only the richer spouse who benefits, partly due to high profile celebrity prenuptial agreements. But here are some surprising benefits for the average Joe.
The main argument of soon to be spouses are: if we love each other and think that this will last, why do we need insurance? But what they often may fail to see is that the insurance works both ways and, if the couple in question has kids, it will mean a much less messy divorce all around. In fact, partners who already have a divorce under their belt are more inclined to have a prenuptial agreement, mostly to protect any children by their prior marriage.
People are often also wary of being cheated out of what they believe that they deserve. But this is not the case in practice. In actual fact, an unfair prenuptial agreement may be rejected by a court during divorce proceedings. The courts are on both your sides, even if your spouse’s lawyer is not. You may not get a fifty-fifty deal but it’s clear where you stand from the start.
Also, full financial disclosure from both parties is a must, so both of you will be aware of the assets and any baggage from the offset. This means that at least you won’t be hoodwinked by your partner with debt you did not know about but are both liable to pay off.
One fact that may be less well known is that prenups also serve to dictate the distribution of assets upon death. This means that even though a couple may not think that they will divorce, they must prepare for the alternative. For many people it also makes sense to also account for the possibility of divorce and this is not a reflection of their love for their partner. They might see it as conflict resolution or simply being fair. If a potential spouse has inherited heirlooms or runs a business, however small, they may simply not relish the possibility of losing these assets in a divorce battle.
In the end, why don’t we prepare for the risk of a divorce in the same way that we may prepare for the possibility that we might accrue a debilitating disease or be involved in an accident: nobody wants to get divorced but we may as well account for it.
Cameron Crowe and Nancy Wilson Divorce

The divorce of Cameron Crowe and Nancy Wilson raises questions about how any marriage is expected to last if this one could not. The director Crowe and his wife Wilson, one of the vocalists and musicians with Heart, were a couple for 24 years before she asked for a divorce in 2010, citing irreconcilable difference. They seemed to have an ideal life together, collaborating on numerous projects and always presenting an amiable impression. News of their divorce broke in September 2010 after the couple had spent two years separated from each other. The divorce was made final in December of that year.
Crowe started his road to fame as a young journalist for Rolling Stone, covering many of the most popular hard rock bands of the 1970s. At the age of 22, he decided to write a book, enrolling in high school to get the background needed for Fast Times at Ridgemont High: A True Story. His career expanded to screenwriting and then directing after his book became a movie. He and Nancy Wilson married in 1986. She was in the peak years of her career as a singer and musician. She also played a small role in the movie version of Fast Times at Ridgemont High and appeared in at least one of the films Crowe directed. Crowe’s career as a director was in the early stages when they married, but he later went on to eclipse his wife’s fame. They co-wrote music for some of his films, and her pieces are featured in many of his movies. The couple has twin sons.
Elizabeth Hurley

After separating in 2010, Elizabeth Hurley filed for divorce from her husband of four-years, Arun Nayar. Hurley cited Nayar’s “unreasonable behavior” as the reason for the divorce.
Hurley and Nayar’s relationship began in 2003. In 2007, the couple wed during a civil ceremony held at Sudely Castle along the English countryside near Winchcombe, Gloucestershire. Following that ceremony, Nayar and Hurley took their vows during a traditional Hindu wedding ceremony in Jodhpur, India.
The couple’s divorce decree was granted by the High Court’s Family Division with District Judge Penny Cushing presiding. Cushing’s ruling held that Hurley’s and Nayar’s marriage had “broken down irretrievably,” which allowed the marriage to be dissolved within six-weeks after the ruling.
Despite the fact that Nayar enjoys a reputation as a business tycoon, his net worth is considerably less than Hurley’s, which could result in Hurley being required to shoulder a multi-million dollar payout in the divorce. Further complicating matters is the fact that neither Hurley nor Nayar signed a pre-nuptial agreement.
In 2010, while still married to Nayar, Hurley made headlines when she was spotted with an Australian cricket player named Shane Warne. After accusations of infidelity, both Hurley and Warne made it clear that they had already separated from their respective spouses.
In October of 2011, Warne proposed to Hurley. The couple made the engagement official with a $100,000 engagement ring, which featured a nine-carat blue sapphire set on either side by two, two-carat diamonds. Since their divorce, Nayar has been dating Kim Johnson, a 25-year-old model.

A celebrity divorce is not necessarily hot news in and around Los Angeles – unless it includes extenuating circumstances. In the case of the marriage between Stacey Dash and Emmanuel Xuereb, there is the allegation of domestic violence, which adds a level of seriousness to the proceedings that onlookers will do well to observe.
The gorgeous Dash is well known to television audiences for her roles in “Clueless,” “Gang of Roses,” “Duck Dodgers” and “The Game.” She has been known as a serial marriage partner, with Xuereb having been her third husband. The marriage lasted barely three years before Dash filed for divorce.
As more details about the relationship are being divulged, audiences are surprised to learn that the self-assured Dash was allegedly subjected to the drunken rages of her ex-husband. Threats and physical violence became part of the marriage relationship. Making matters worse, the actress has two children for whose safety she feared as well.
On Jan. 29, 2010, Dash filed for divorce and a restraining order against Xuereb. In Sept. 2011, the L.A. County Superior Court judge finally added an official signature to the paperwork, making the split official. While audiences continue to enjoy watching Dash in her television and film work, it is important to remember that even the famous and the beautiful may suffer due to domestic violence.
In situations, such as the violent marriage between Stacey Dash and Emmanuel Xuereb, divorce is the only answer for the continued safety of the abused spouse. This is especially true when children are involved.
Here is to hoping that the two can make it work in the long run, at least until their child is ready to leave the nest and head off to college – in about 10 years.
Dan Cortese Divorce

Actor and MTV Rock 'n Jock host Dan Cortese filed for divorce shortly after Thanksgiving from his wife Dawn, also known as Dee Dee, Hemby in L. A. Superior Court. Besides MTV, Cortese also starred in the television show Melrose Place, played a recurring role in Seinfeld, starred or supported in several movies in the 1990s, and also served as a Burger King spokesman during the “Your Way, Right Away” advertising campaign. Dawn / Dee Dee Hemby is also an actress but never rose to prominence as her ex-husband once did.
Unlike many television personalities, who of late have been divorcing at a rate that's been almost faster than the rate of their highly-publicized marriages (think Kim Kardashian and Kris Humphries), Dan Cortese and Dawn had been married for over seventeen years. The couple married in 1994 and they have two children together, India and Roman.
Not many details are available about the divorce between Dan and Dawn; so far, news outlets that have covered the divorce only report that calls to Cortese's publicist have not been returned. There aren't many details available regarding what went wrong. The only documented sign of marital trouble is the fact that the two put their Malibu home on the market back in June 2011.
Another divorce amongst Hollywood's A-list – or, in this case, B-list – actors seems to be par for the course in the world of celebrity relationships. It seems that the group of them do a much better job portraying storybook romances on-screen than they do living them in real life

On television, Patricia Arquette was best known as a psychic on the show "Medium." However, in real life, no amount of foresight could spare the actress from the pain of divorce.
In July, Arquette's divorce from actor Thomas Jane was finally finalized after several tumultuous years. The pair had first filed for divorce in 2009, with paperwork from Arquette citing irreconcilable differences. However, after six months, the duo reconciled, apparently giving their marriage a second chance.
Arquette and Jane spent another year together, seemingly working through their issues like any committed couple would. However, despite all apparent efforts from both Arquette and Jane, the couple filed for divorce a second time in August 2010. The ultimate reason cited for the divorce was again irreconcilable differences. This time, however, the divorce was finalized on July 1, 2011.
Despite the stressful ending to their marriage, the couple spent nearly a decade together. They first met in 2001 through mutual friends; their daughter, Harlow, was born in early 2003. After several years of happy engagement, the low profile pair finally married in 2006.
Some reports have suggested that the split turned bitter, especially in regards to the custody of their daughter. However, Arquette has spoken publicly regarding the split, insisting that she and Jane are amicable. Their settlement detailed a joint custody agreement.
While neither actor has spoken about their future plans, it seems safe to assume that this time the divorce will finally cement a permanent, if unfortunate, separation for the couple.
